1. Who we are

2. What you're agreeing to when you buy

Your monthly price depends on your business and market, and we set it together on your setup call. We then send you a Stripe payment link for that price. The price on that link is the price these terms refer to throughout. Here is what the plan is and how the billing works.

Your plan

Automated reviews, Google Business Profile optimization, local visibility and AI search for home services and contractors. It is billed every month on the same date, at the monthly price on your payment link.

Free trial (when your plan includes one)

If your payment link includes a 10-day free trial, you pay $0 when you enter your card. Stripe charges your monthly price to that card automatically on day 11. Cancel before the 10 days end and you are not charged. If your payment link does not include a trial, your first monthly charge is made when you pay on the link.

No contract. Your plan is month-to-month. Cancel any time by emailing support@omnipresent.app or by calling (619) 975-1535. Cancellation takes effect immediately and you are not billed again after it. On cancellation you retain your Google Business Profile, every review earned, and a full export of your customer data. Your Google Business Profile, your reviews and everything posted to it stay yours. Our management, review requests and reports stop.

Text-message features depend on carrier approval. Review request emails go out right after signup. Review request texts start once the carriers approve your texting number, typically within 3-5 business days. The carriers decide the timing, and that approval is outside our control.

Results guarantee: we guarantee more Google reviews and a higher Google ranking, or your money back. If you don't get both, email us within your first 30 days of paid service and we'll refund your most recent monthly payment. The guarantee applies once you've shared your customer list with us and your review requests are running. See Section 4.

3. Auto-renewal disclosure (California ARL compliance)

This section satisfies California's Automatic Renewal Law (Business and Professions Code Section 17602). Read it before you start your plan.

Stopping a charge before it happens

Your subscription bills on the same date every month, starting on the day you first pay (or, with a free trial, day 11), so you always know when the next charge is due. To stop the next charge, email support@omnipresent.app or call (619) 975-1535 at any time before that billing date. With a free trial, to stop the first charge, do this before the trial ends. Cancellation takes effect immediately and you are not billed again.

How to cancel

You can cancel in either of two ways. Both are accepted and processed immediately:

• Call (619) 975-1535 and tell us you want to cancel.
• Email support@omnipresent.app and tell us you want to cancel. Any email that says you want to cancel is accepted.

Cancellation takes effect immediately. You are not billed again after the cancellation date.

What you retain on cancellation: you retain your Google Business Profile, every review earned, and your customer data (we deliver a full export within 7 business days). Your Google Business Profile, your reviews and everything posted to it stay yours. Our management, review requests and reports stop.

Monthly system recurring terms

The monthly system is recurring monthly and auto-renews until canceled. No long-term contract. Cancel any time using the methods above.

4. Refund policy

• Free trial: If your plan includes the 10-day trial, you pay $0 during it, so there is nothing to refund. Cancel before it ends and you are never charged.
• Results guarantee: we guarantee more Google reviews and a higher Google ranking, or your money back. If you don't get both, email us within your first 30 days of paid service and we'll refund your most recent monthly payment. The guarantee applies once you've shared your customer list with us and your review requests are running.
• Your plan: Month-to-month. Cancel any time. No refund for partial months, other than under the results guarantee above.

No other results promised: Google and AI search tools decide their own rankings and answers, and they can change how they work at any time. Outside the results guarantee above, we do not promise a specific ranking position, number of reviews, calls or jobs, or placement in AI search answers. Example screens on our website are illustrations, not a promise of a specific result.

5. Data and privacy

Your customer list

The past-customer list you upload (names, phone numbers, emails, job history) is used only for your campaign. We never sell it, share it, or use it for other clients. You own it. On cancellation, we deliver a full export within 7 business days and delete our copies within 7 business days after that.

Tracking on this site

We use analytics and advertising measurement on omnipresent.app, disclosed in full in the Privacy Policy: Google Analytics 4, Microsoft Clarity, and the Meta Pixel (ad measurement and retargeting audiences). Payment processing runs through Stripe. CRM and campaign delivery run through GoHighLevel.

Your data rights

California residents have rights under the California Consumer Privacy Act (CCPA) to know what personal data we hold, request deletion, and opt out of any sale of personal data. We do not sell personal data. To exercise any CCPA right, call (619) 975-1535 and tell us it's a CCPA request. We respond within 45 days.

6. Text messaging terms

What the program is

Two kinds of text message run under these terms. Review requests: after a job is marked complete, your business asks its own customer for a review by text. Your business sends from its own toll-free number, verified by the carriers in your own legal name and used by your business alone. Texts from Omnipresent Marketing to you: when you give your phone number on this website, for example in the free trial form, you agree to receive texts about your trial and appointment from Omnipresent Marketing. No promotional or marketing texts are sent under either program, and no one is texted who has not given their mobile number for that purpose.

Message frequency

Message frequency varies. For review requests, typically 1 to 3 messages per completed job: one request after the job is marked complete, then up to two follow-ups a few days apart. Follow-ups stop as soon as the customer clicks the link or replies. For texts from Omnipresent Marketing about your trial and appointment, message frequency varies.

Rates

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Consent to receive these messages is not a condition of any purchase.

STOP and HELP

Reply STOP to any message to end all texts from that number. The opt-out takes effect immediately and you may receive one confirmation. STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, and REVOKE all work. Reply HELP for help, or email support@omnipresent.app or call (619) 975-1535. You can also ask the business that texted you to remove you directly.

Messaging data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. Full detail is in the Privacy Policy.

7. Limitation of liability

Our total liability under these terms is capped at the fees you paid us in the last 12 months.

We are not liable for indirect or consequential damages, lost profits (other than the refund clause in Section 4), force majeure events, or third-party platform issues (Twilio outages, GoHighLevel downtime, Google policy changes, Stripe issues, and the like).

9. Changes to these terms

We will email any material change to the billing address on file at least 30 days before it takes effect.
